In order to be binding, an international agreement is required to be given consent by all the parties to the agreement. This is called the ratification of the agreement. Therefore an international agreement is binding only on the parties that have ratified such agreement and only after the ratification of the agreement, it becomes a part of the legal order of such country (Tridimas and Eeckhout, 1994). Therefore in the present case, Spain is required to sign the agreement. However if due to internal political reasons, Spain is not willing to sign the agreement, it will not apply to Spain even if it has been signed by the EU and all its Member States.
