However, as resource persons for general educators, administrators, and school boards, special educators must be aware of both legal requirements and best practices.
The laws governing athletic participation of students with disabilities are vague because of the split in court decisions and the far-reaching potential of applicable regulations. Also, many jurisdictions have not generated relevant case law, thus leaving schools in other jurisdictions. In this case there is a risk that they do not make cautious decisions.
Wise practice often includes not just legal requirements, but also professional norms. Although it may seem that laws and regulations required from the school officials have no connection to the Americans with Disabilities Act's application to athletics, it is not so. Practicing the Americans with Disabilities Act in the sphere of athletic on the local area gives a confidence that those performances will be executed regarding professional athletics as well.
