The difference between the two systems is the manner in which competing applications for the same invention are dealt with. Under the "first-to-invent" system, only the applicant shown to have been first to make the invention is entitled to the Patent while in the "first-to-file" system, only the applicant who is first to file a patent application is entitled to the Patent. At present time, most countries are operating under the "first-to-file" system except in the United States. Therefore, if Lucky Connection is to be set up in Malaysia, then the company have to make sure that they file their every newly found patents immediately to prevent the possible threats of losing it.
The next issue deals with the extensive use of computer-implemented methods for processing biological information. Like in the states, the United States Courts have opened the door to patenting of information processing inventions by finding that methods, which produce new information, are not precluded from patenting.
